Ranch resident Carol Orr sat down with Ranch Matters and wanted us to know that she has no intention of paying the $250.00 FINE re-imposed by Ranch President Kari Vickery on November 7, 2022, until she’s granted “her day in court.”

Orr stated she’s been accused of an alleged violation and feels she has a right to openly- publicly, defend herself against what she characterized as a vendetta.

At the October 28 Candidates Forum, Vickey talked to Orr about the pending FINE that was imposed by her predecessors, Bill Burt and Carl Harbour. Vickery suggested Orr submit a “paragraph” requesting the $250.00 FINE be reviewed.

On November 4, as directed by Vickery, Orr submitted her paragraph/letter with an attached RESOLUTION VIOLATION APPEAL FORM provided by Vickery. The Form incorporates a YES/ NO REQUEST for an accused to be allowed an opportunity to a hearing, an in person presentation. Orr asked for it and it was IGNORED and/or DENIED by Vickery.

Orr feels she should be able to present a defense and that if indeed she’s allowed to, the facts will support the case against her being dismissed.

That being said, does Orr have some legal authority backing up her case?

Oregon Revised Statute (ORS) 94.657 specifically addresses RULES OF ORDER-ROBERT’S RULES OF ORDER and the right of an accused DUE PROCESS.

The accused is entitled to a clear understanding of any allegations, sufficient time to prepare a defense, present a defense and call witnesses.

Orr’s of the opinion that she has a right to demand an in person-defense, predicated in part on statutory authority. She also feels that the conduct of the Board using financial penalties is a form of “coercion” and an intimidation tactic to silence her and residents the Board deems the enemy.

NEXT STEP?

Orr believes the conduct of the Board needs exposed and plans on “Going public everywhere and anywhere, including seeking government oversight.”
