VICTIM or VOYEUR?

As reported earlier, Ranch Matters (RM) has published several stories regarding a lawsuit filed June 9, 2021, against the Crooked River Ranch Association by Ranch resident Lisa Andrews. Her lawsuit involves the CC&R complaint process and in particular the Associations duty to maintain confidentiality when a CC&R complaint is filed.

Ms. Andrews and her partner, Ian Kurtz, were allegedly having some issues with their neighbor, Kelly Davis and filed not one, but as recently learned, two CC&R complaints against Davis on June 29, 2020.

As reported, the Association’s attorney filed their ANSWER on August 27, 2021 and admitted a CC&R review Committee woman “ACCIDENTALLY” called Kelly Davis, the target of Ms. Andrews and Mr. Kurtz’s CC&R complaint.

The Ranch Association admitted their guilt and claimed it was just an accident. So what did they do? they passed the BUCK and filed a THIRD-PARTY LAWSUIT against Kelly Davis on September 1, 2021.

WHATS NEW?

On January 3, 2022, the Association’s attorney filed

“DEFENDANT’S (CRR) AMENDED ANSWER AND AFFIRMATIVE DEFENSES” that included a second CC&R complaint filed by Lisa Andrews that was not included in the original August 27 ANSWER. Both CC&R complaints reflect June 23, 2020, as the incident date and further reflect the “Complaint Case Numbers as 20-51 and 20-52” respectively.

Additionally, the number 12000079 appears at the top of the two complaints and they were both stamped received by the Ranch on June 29, 2020.

Ms. Andrews second CC&R complaint (20-52) starts off: “Beginning at 2 AM the residents of 9134 began having sex on their front porch visible from the road. The adult female at the residence began screaming yelling/shouting very loud and inappropriate statements. This lasted for hours…”

Her complaint noted in the margin that the “Jefferson County Police Department”  was contacted, however, the Sheriff’s Report does not mention any sexual activity occurring.

 

The Ranch lawyer also filed on January 3, 2022, an “AMENDED THIRD-PARTY COMPLAINT” that now named Ashley Strouse as a Third-Party Defendant. Ms. Strouse was listed as “Jane Doe” in their August 27 ANSWER.

Today, RM met with Kelly Davis regarding the Amended filings. Davis stated he only knew about the Association’s lawyer filing some Amended documents, but was unaware of the attached exhibits, including Ms. Andrews “mysterious” second complaint.

Davis reviewed the Amended documents and was asked if he had sex with that woman as described in Ms. Andrews CC&R complaint. He responded “NO.” Davis immediately added that he did engage in sexual activity around “10 PM” with his fiancé inside the privacy of his home-not outside or on the porch. He reminded us it was summer time and he typically leaves his door open and sound carries.

Davis asked rhetorically, “What was Lisa Andrews doing looking into my house, is she a Peeping Tom?”
