No DUES Process Rights
“…YOU ARE DOING YOUR CLIENTS A DISSERVICE…”
“DISSERVICE”?
According to Ranch resident Lynn Breeden, they were forced to retain the Fitch Law Firm in Redmond over a protracted “DUES WAR” with the CRR/HOA, specifically with Ranch Manager Judy Lapora, her “attack dogs”- attorneys Kevin Harker/Bruce Lepore and the CRR Board of Directors.
.
Breeden told Ranch Matters (RM) after reading our story, “DUE PROCESS RIGHTS NUKED” he felt compelled to tell their story or personal “nightmare” they are currently experiencing in trying to settle their case with the Association.
Breeden: “For about the last year, we have been trying to ascertain exactly what we owe in dues and associated costs-it’s like pulling teeth. We have received several conflicting BILLS/ STATEMENTS and when questioning the actual amounts we’ve been penalized.”
.
He added: “I know we owe money, however, on the heels of the COVID crisis and the current uncertain economy, meeting our financial obligations has been really tough. That being said, about a year ago, we took $3,000 cash to to the Ranch Admin and they refused the money.
Following that we did my best to negotiate with the lawyers unrepresented and got in over our heads. All along we were simply asking for an accurate accounting.”
Breeden: “More recently, on February 28th, 2025, we hand delivered to the Ranch Association a cashier’s check for $4,500 bucks with an attached letter that stated:
Please see attached cashier’s check # 0852204922 in the amount of $4500 which satisfies our dues owing on account #5337 to Crooked River Ranch Association. We have asked for breakdown of the lawyers services and just received it 2/25/25 and need time to review. We are questioning why the lawyers bill is so high for the alleged work performed. It’s our intention to get this matter behind us to everyone’s satisfaction and hopefully the Ranch will demonstrate some understanding of this matter.”
“After paying the $4500 and awaiting on an accurate accounting we learned they were not interested in settling this matter. They garnished our bank account on March 31 without any additional discussion forcing us to retain the Fitch Law Firm in Redmond.”
“Our lawyer, Andrew Fitch wrote the Ranch lawyers questioning the bill and the process behind this mess. Unbelievably, they wrote back accusing our lawyer, Andrew Fitch of committing a “disservice” by representing us. So, not only are they demeaning our lawyer and our right to hire one, but they also warned him that any correspondence from him will be further penalized against us. In fact, they charged us another $1,074 just for this one letter.”
“Not hiring an attorney when one faces a Goliath or an unaccountable HOA is a fools errand.
We did our best trying to navigate the HOA’s maze of twist and turns to no avail and had to finally hire an attorney. They penalized us for exercising our rights. They apparently didn’t like us seeking a fair and equitable solution and like your story said, they don’t believe we have any DUE PROCESS RIGHTS or in our case DUES PROCESS RIGHTS.”
