Mr. Montgomery has been involved in the Badger Hill situation since 2012. Ownership of Badger Hill is an unresolved issue and there’s never been an official easement granted by the property owners.

“It’s just a road that we built through these two people’s property.”

Montgomery explained the recent safety concerns associated with Badger Hill Road, guardrails, legal matters and some options.

Montgomery commented: “Right now, the property owners, I believe are at great risk. Somebody gets in a wreck on that road right now, whose responsible-whose property did it happen on?

If somebody dies or got crippled, it’s a possibility, I’m not an attorney, it’s a possibility and stranger things have certainly happened.”

“To protect those property owners and to give us the legal right to keep it maintained and safe, the best thing to do would be to make it a public right-of-way.”

The SRD Directors voted to proceed and contact initially the Badger Hill property owners before retaining Engineer Scott Montgomery’s services.
