John Stevens vs. Crooked River Ranch Special Road District, and John Williams, Commissioner, Defendant Case No: 18 CV 03272

ONE YEAR AGO TODAY

One year ago today a Public Records lawsuit was filed against the CRR Special Road District and SRD Commissioner John Williams for failing to provide requested public records.

Today, the lawyers battled it out in front of Jefferson County Presiding Judge, Daniel Ahern, arguing over attorney fees for the Plaintiff.

Plaintiff's attorney, Robert Birk, presented his case along with relevant evidence in support of his attorney fee claim.

The Defendant's attorney, Timothy R. Gassner, presented a more emotional and less substantive case, throwing many personal insults and unfounded accusations including that the Plaintiff's attorney did not even author his own Complaint.

Interestingly, in Gassner's OBJECTION TO STATEMENT FOR ATTORNEY FEES AND HEARING MEMORANDUM, he riddled his Objection with malicious, ill-founded and in some cases inaccurate information. At one point, accusing Plaintiff as acting "recklessly and in bad faith", going as far as referencing the January 10, 2018 SRD meeting saying, "....they (SRD) are subject to constant interruptions and accusations from both Plaintiff and his cohorts as they disrupt the meeting with conspiracy allegations and representations..."

For Gassner to make the claim that Plaintiff's attorney did not author his own Complaint, is not only unfounded but a conspiracy theory on its own.

Judge Ahern asked questions regarding timelines, chronologies and the responsibilities of the SRD as a Public Agency, including what had been provided to Plaintiff thus far.

Judge Ahern stated that he would have a written opinion provided in the next 30-60 days, prior to his retirement on March 29, 2019.
