JEFFERSON COUNTY BOARD OF COMMISSIONER’S MEETING

Ranch Matters attended yesterday’s (01/26/22), Commissioner’s Meeting in Madras.

All three Commissioner’s present and newly appointed Chairman, Wayne Fording facilitated the Meeting.

ITEM OF INTEREST:

Recently hired Community Development Director, Scott Edelman provided his detailed report regarding the “Expanded us of a hearings officer.”

 

In a nutshell, Director Edelman’s report is about the “County considering the use of a hearings officer for certain land use decisions and appeals.”

According to Edelman, “Currently, the county utilizes a hearing officer only for code enforcement proceedings. At the direction of the Commission, staff conducted research into the use of a hearings officers for land use decisions by other counties in the state…”

Edelman explained, “…the primary benefit of utilizing a hearings officer is to ensure a solid legal decision is made, grounded in state law (including case law) that is more likely to avoid or withstand an appeal to the State Land Use Board of Appeals (LUBA).”

“The main drawback is the additional costs of processing the application or appeal.”
