OREGON COURT OF APPEALS INVALIDATED COLUMBIA COUNTY ORDINANCE
“Oregon Attorney General Rosenblum announced today that the Oregon Court of Appeals has invalidated a Columbia County ordinance that claims to nullify state and federal gun safety laws within the county.

The ordinance was adopted by the Columbia County Board of Commissioners in March of 2021. It had been preceded by two similar voter-enacted measures. After adopting the 2021 ordinance, the county brought a legal proceeding asking the courts to determine whether the ordinance is valid.

The Oregon Department of Justice (DOJ) appeared in the proceeding, arguing that the ordinance violates state law and is invalid…”

Oregon Attorney General Opposing 2nd Amendment Sanctuary Movement
.
On April 30, 2021, Oregon Attorney General Ellen Rosenblum filed an APPEARANCE/ PLEADING opposing the 2nd Amendment Ordinance in Columbia County.
The Petition was filed by the Board of Commissioners of Columbia County seeking judicial review of the Second Amendment Sanctuary Ordinance.
Apparently, Columbia County wants to follow the will of the voters, but needs the court to determine whether the voters will can be followed.


The Attorney General’s APPEARANCE states in part, “The Attorney General requests that the court declare that Initiative Measure 5-270, Initiative Measure 5-278 and Ordinance No. 2021-1 are invalid, because, inter alia, they conflict with and are incompatible with State’s criminal laws (including ORS 166.170-490), the duties of the Columbia County Sheriff, the duties of the Columbia County District Attorney, and the duties of other officers and departments of Columbia County…”
