Real Estate listings on the Ranch are on the rise and Ranch Matters was asked, is there a duty on the part of the seller and or real estate broker to disclose any pending legal issues?

We looked into this and learned that state law dictates that indeed property owners have a duty to disclose any pending litigation. Every potential seller has a legal obligation to fill out a “SELLER’S PROPERTY DISCLOSURE STATEMENT” and listed on the Statement Form is a section labeled, “COMMON INTEREST”.

The seller is asked, “Is the Home Owner’s Association or governing entity a party to pending litigation or subject to an unsatisfied judgment?”

Additionally, another question addresses special assessments,

“Are there any pending or proposed special assessments?”

Recently, we had an opportunity to meet with a real estate broker that sells property throughout Central Oregon and on the Ranch. He stated he had heard “there’s some trouble on the Ranch”, but did not know about the pending lawsuit. We provided background related to the lawsuit, filed in Jefferson County in 2018 and the broker admitted this matter should be disclosed.

 

 

Central Oregon media has elected to avoid covering the pending lawsuit and Ranch Officials have done a great job keeping the Ranch Membership in the dark.
