As reported earlier, Ranch Matters published a report titled “I AM GOING TO KICK HER ASS, I AM GOING TO KILL HER” regarding a lawsuit filed June 9, 2021, against Crooked River Ranch Club & Maintenance Association by Ranch resident Lisa Andrews.
Her lawsuit involves the CC&R complaint process and in particular the Associations duty to maintain confidentiality when a CC&R complaint is filed. Ms. Andrews attorney’s lawsuit alleges: “Negligent Breach of Confidentiality; Breach of Confidentiality and he’s seeking about a million bucks.
Ms. Andrews and her partner, Ian Kurtz, were allegedly having some issues with their neighbor, Kelly Davis and filed a CC&R complaint against him on June 29, 2020, after being assured their contact information would remain confidential.
Lisa Andrews lawsuit alleges: “On July 1st, 2020, the neighbor to whom Ms. Andrews’ and Mr. Kurtz’s complaint was directed, the domestic partner of Mr. Kelly Davis, came to Ms. Andrews’ door while Mr. Kurtz was at work. The neighbor was screaming and yelling, cursing, threatening, and banging on Ms. Andrews and Mr. Kurtz’s front door while trying to open it. Ms. Andrews heard the neighbor screaming ‘I am going to kick her ass. I am going to kill her.’ The neighbor was also joined by another person, presumably Mr. Davis. Ms. Andrews did not answer the door out of shear fear, panic, terror and the fear of the threatening woman breaking into her house. The yelling and banging on Ms. Andrews’ door persisted for approximately 10 minutes.”
The Association’s attorney filed their ANSWER on August 27, 2021 and admitted a CC&R review committee woman “ACCIDENTALLY” called Kelly Davis, the target of Ms. Andrews and Mr. Kurtz’s CC&R complaint.
The Ranch Association admitted their guilt and claimed it was just an accident. So what did they do, on September 1, 2021, they passed the BUCK and filed a THIRD-PARTY LAWSUIT against Kelly Davis.
According to Mr. Davis, he found out about the original lawsuit against the Association on August 6, 2021 and immediately contacted Ranch Manager Judy Lapora. He stressed the allegations against him listed in Andrews’ lawsuit were false and categorically denied making any threats of any kind against Ms. Andrews. Davis offered Lapora proof, evidence/ information/assistance and suggested she contact the attorney representing the Ranch. Lapora replied: “That’s interesting.”
A month later and while expecting to hear from Manager Lapora, Davis is served the THIRD- PARTY LAWSUIT from the Ranch Association on September 7, 2021.
While reviewing his THIRD-PARTY LAWSUIT with us Davis pointed out that the Ranch attorney attached copies of their ANSWER that included the subject CC&R complaint, dated June 29, 2020. Also attached, a Jefferson County Sheriff’s “Noise” complaint dated, June 23, 2020, reported by an “anonymous” party who refused to disclose her name, complaining about a “Female yelling obscenities off her porch” at 9134 SW Sundown Canyon Rd-Kelly Davis’s residence.
Davis was asked about the events of July 1, 2020. He stated: “About 12:30 PM I received a phone call from the Ranch and they asked, is this Kelly Davis? I said yes and they said we’re calling about the complaint you filed against your neighbor. I said I didn’t file any complaints against my neighbor. They replied, oh well we have…this is Mr. Davis, right? Oh wait never mind, we can’t talk to you anymore. I said, you used my name, so obviously I’m involved in this somewhere. Tell me what’s going on-they hung up.”
After receiving the above phone call Davis and Kurtz communicated via TEXT throughout the day and later actually met. Davis said their discussions were cordial and there was no mention of any earlier threats or police involvement.
Mr. Davis was disturbed by the “false” allegations made against him by Ms. Andrews and questioned, why she didn’t call the police. He further stated he wasn’t contacted by any police and personally checked and found no record indicating Andrews called or filed any threat related reports.
Due to the seriousness of Andrews accusations, Ranch Matters filed an Oregon Public Records Request with the Jefferson County Sheriff’s Office and obtained a copy of a “Threat” Report, dated July 1, 2020, reported by Ranch Manager Judy Lapora and not Ms. Andrews.
We met again with Mr. Davis and showed him Lapora’s Threat Report and he was shocked, confused and upset. He said, “Who contacted her (Lapora) and if they (Andrews/Kurtz) were afraid for their lives, why contact the Ranch Manager and not the police?”
Davis stated: “What I’m thinking happened, is they (Andrews/Kurtz) got mad because they found out I knew they complained…”. They called her pissed off and I think she’s (Lapora) trying to cover her ass by saying, oh well I better report this to the police then, because something happened, so I’m going to make this about them and not me, in my opinion.”

WHAT’S NEW?
Lapora filing the Threat Report as opposed to Ms. Andrews piqued our interest and so we dug a little deeper.
On October 6, 2021, we filed another Oregon Public Records Request with Frontier Regional 911 requesting the 911 Call/AUDIO RECORDING initiated by Lapora on July 1, 2020, along a copy of the CAD EVENT REPORT.

Frontier’s Director confirmed they have the requested records stating: “Yes, I have located the Cad Incident and the audio of the admin call received from Judy.”
The CAD Incident/THREAT Report provided was unredacted and confirmed Ranch manager Judy Lapora as the Reporting Party. COMMENT SECTION: “RP (Lapora) HAS PEOPLE THAT LIVE AT ABOVE ADDRESS SAYING THAT THEIR LIVES BEING THREATENED BY NEIGHBOR/RP WANTS DEPUTY TO COME TO OR CALL CRR ADMIN OFFICE FIRST AS THEY ARE THERE.”
The CAD Report reflects the deputy ARRIVING at the Ranch Administration Office at 2:44 PM and he CLEARED at 3:13 PM noting the matter was “CLOSED.”

911 CALL: “Hi, this is Judy Lapora at Crooked River Ranch, and I have a couple here, they’re in my office right now… we have a situation where, they’re being, their lives are being threatened by their neighbor-they’re in my office because of this and I need to have a deputy come here… “

As part of our follow up, we additionally filed a second Records Request with the Jefferson County Sheriff’s Office asking for the responding deputy’s NOTEBOOK NOTES regarding the July 1, 2020, THREAT REPORT.
The Sheriff’s Office forwarded 1 redacted page from the deputy’s Notebook. The notes only reflect the names of those involved and provided no details, statements, narratives or follow up.
Davis was recontacted for updates and he stated his lawyer hasn’t filed an ANSWER due to some apparent discrepancies in the story the Ranch was told. “The Ranch attorney said, that’s not the story we got, so we’re going to do some investigation.”
“…THAT’S NOT THE STORY WE GOT…”?
Davis asked, “WHAT STORY are they talking about?” He added: “Why have this whole story- Well I get it, they’re pissed off because they (Ranch) called me on accident, so they said, oh, they came up with a story. Now they have a reason to be upset with the Ranch because the Ranch screwed up. So they fabricated this story to have an actual reason to complain.”
“Power of reason suggests-that they were down there because they were upset that they were contacted-that it was leaked out that they complained and that’s why they were down there.”
According to Davis, his attorney wrote Andrews’ attorney and the Ranch attorney looking for the case to be dropped. “If Andrews attorney drops it, it’s done. If he doesn’t drop it I’m filing a countersuit against the Ranch for attorney fees and punitive damages for a frivolous lawsuit and then I’m going to file a lawsuit against the neighbors for libel.”
