Today, Jefferson County Circuit Court Judge, Annette Hillman heard arguments for and against the Water Company’s Motion to Strike.
The Motion argument was predicated on an unauthorized Answer filed by the water Company’s former attorney. According to court documents, Water Company General Manager, Frank Day, defendant for the Crooked River Ranch Water Company, filed a Declaration “IN SUPPORT OF DEFENDANT’S MOTION TO STRIKE ANSWER AND AFFIRMATIVE DEFENSES.”
Mr. Day’s Declaration eluded to the lack of communication between him and the Water Company’s former law firm. Day stated in part, “The Answer was not authorized and does not represent the defendant’s position.”
Judge Hillman listened carefully to said arguments and was familiar with the case specifics thus allowing her to render a decision immediately, in favor of the Water Company. She allowed the defendant’s Motion to Strike and requested the Order be written by the Water Company’s lawyer.
A Pre-Trial Conference is scheduled for October 21, 2020 with a Trial Date set for November 9, 2020.
