Ranch Matters posted a story titled, “GAME OF CHARADES” on 1/14/19 and part of the story addressed conflicts of interest. We cited from two sources-Special District Elected Officials Guide and ORS 244 regarding Potential conflicts, as well as, Actual conflicts.

Yesterday, (1/17/19), we posted a story titled, “3 MONTH TO THE DAY” regarding the Court Ordered search of SRD Commissioner John Williams computer hard drive. As reported, Madras Computers conducted the search and produced a Flash Drive containing “30,000 Files.”

Ranch Matters Staff is reviewing the contents on the Flash Drive and one of the first files uncovered is an UNSIGNED agreement titled, “WAIVER OF CONFLICT.”

In a nutshell, the agreement spells out that an Actual conflict exists between Madras attorney Timothy R. Gassner and his wife, Jefferson County Counsel, Alexa N. Gassner, “regarding the agreement related to construction, operation and maintenance of the Quail Road Extension Project.”

The “WAIVER” section of the agreement states, “Crooked River Ranch Special Road District hereby acknowledges that a conflict exists based upon the marriage relationship between Timothy R. Gassner and Alexa N. Gassner. Crooked River Ranch Special Road District acknowledges that it has been recommended to them to seek independent legal counsel with regards to their rights and interests in providing this consent and that they have had a reasonable opportunity to do so. Crooked River Ranch Special Road District is willing to waive any conflicts in this case recognizing that there is no interference with the independence or professional judgment of Timothy R. Gassner, Timothy R. Gassner is able to provide competent and diligent representation while maintaining strict confidence of sensitive information and consent to his representation of the Special Road District. Any agreement negotiated by counsel for the Special Road District is subject to approval by the SRD Board of Commissioners.”

The unsigned agreement has three signature lines: “Richard Hoffmann-President CRR Special Road District, Mike Schlabach-Treasurer CRR Special Road District and John Williams- Secretary CRR Special Road District.”

Ranch Matters does not know whether this agreement has been executed, we are simply reporting what has been discovered so far-we have 29,999 files to go.
