BURT’S TAR PIT

Last Thursday, (9/8/22), we published a story titled, “IMPORTANT UPDATE” regarding the Jefferson County Planning Commission receiving a LETTER OF SUPPORT for the MacPherson Development Project from outgoing Ranch President Bill Burt.

The letter is dated September 7, 2022, signed Bill Burt, President and clearly states the Board’s approval.

As reported, the Planning Commission received the letter of support on the same day Burt was replaced as President by newly elected Director, Kari Vickery.

We’ve checked the Ranch Minutes and found no evidence that this letter of support was ever openly discussed at any meeting pursuant to Oregon law.

The April 18, 2022, Minutes reflect the following: “SPECIAL PRESENTATION -Linsey McLane- Godwin, Planner ll with MSS Inc. presented drawings for a proposed 54 lot rural residential sub-division on land currently held by the MacPherson family. She explained that are not focusing on commercial development at this time. She answered questions presented by the Board members.”

There was no further information suggesting the Board’s position or letters of support in the above described April Minutes. Nor in minutes of any other Board Meeting since.

FAST FORWARD

At the September 7, Work Session Meeting, Burt administered the oath of office to the new Directors and passed the baton to President Kari Vickery. President Vickery took charge of the meeting and followed the posted agenda. There was nothing listed on the agenda regarding the MacPherson’s family development or any letter of support. Additionally, there was no discussion or even a hint that Burt’s letter was on its way to the Planning Commission.

Interestingly, the meeting adjourned to Executive Session at 11:59 a.m. At 12:31 p.m. they reconvened and reported

“No action was taken and no items discussed.”

For a half hour they met in executive session and did nothing?

.

Did Burt over step his authority? Or was the Board directly involved in the decision to support the MacPherson’s development?

If the Board was a party to Burt’s letter when did they discuss this letter and decide to submit it to the Planning Commission in any meeting open to the Association Homeowners?

Did Burt and or the Board take the time to consider whether they were complying with Oregon law and the consequences for failing to comply?

If the Board never discussed this issue in an open meeting does the letter have any legal significance? ORS 94.644(2)(c).

The Board can’t skip meetings to make decisions in secret. ORS 94.644(3).

Does President Vickery’s new Board want to step into BURT’S TAR PIT or would they rather address the matter in an open meeting for the homeowners and make sure everything is transparent and legal?
